Two Kalispell Chiropractors Will Pay Montana $450,000 in Restitution After Medicaid Fraud Allegations
HELENA, MT: Cody C. Basler, 36, and Erik M. Lund, 30, will pay back funds to Montana Medicaid, along with civil penalties and damages.
According to the Montana Department of Justice, between May 2017 to December 2021, Basler and Lund submitted treatment claims to the Montana Medicaid program that were deemed not "medically necessary." During this time, Basler owned and was the president of Basler Family Chiropractic, and Lund worked as an employee.
Basler will pay a total of $300,000, with $267,000 going to the Montana Medicaid program. Lund will pay a total of $150,000, with $87,000 going to the Montana Medicaid program. Due to the agreement to pay back Montana Medicaid, Basler and Lund do not admit to committing fraud.
The Montana Department of Justice released the following information:
Two chiropractors in Kalispell have agreed to pay the State $450,000 for restitution to settle allegations of Medicaid fraud, Attorney General Austin Knudsen announced today.
The Montana Department of Justice’s Medicaid Fraud Control Unit (MFCU) received a referral from Blue Cross Blue Shield of Montana alleging Cody C. Basler, 36, and Erik M. Lund, 30, submitted clahns to the Montana Medicaid program for treatment that was not “medically necessary,” as defined by the State of Montana, from May of 2017 to December of 2021. During that time, Basler was the owner and president of Basler Family Chiropractic and Lund was an employee.
During an investigation into both doctors’ records from May 2017 through October 2021, MFCU identified claims that were non-reimbursable for reasons including that the referral was not directly related to a neuromuscularcondition of the spine, the documentation reflected a reason for treatment was “general wellness,” and they lacked documentation of a patient’s loss of function or impairment.
Under the terms of both agreements, Basler and Lund are not admitting to wrongdoing, however, both are repaying the money to Montana Medicaid. Basler agreed to pay a total of $300,000. The majority, $267,000, will reimburse the Montana Medicaid program and make it whole. The balance represents additional civil penalties and damages. Lund agreed to pay a total of $150,000 of which $87,000 will reimburse Montana Medicaid with the remainder representing civil penalties and damages.

Boca Raton Chiropractor is Facing a Lawsuit in Palm Beach Court Allegedly Burnt Patient During Social Media Ads
BOCA RATON, FL: According to the complaint, a patient claims that the Chiropractor burned him — causing serious injury — while simultaneously treating him and photographing him for an advetisement. From the complaint:
“On November 15, 2021, a patient presented for treatment with a chiropractor at a facility operated by Anodyne of Boca Raton.
Prior to scheduling the November 15. 2021 appointment, upon the chiropracoros’s request, the patient agreed to serve as a “back model” for the Chiropractor, and agreed to be photographed while being rendered care, presumably for the chiropractor to utilize and market her services and to provide social media content. The patient performed chiropractic treatments on the patient which included manual therapy via cupping and scraping, along with chiropractic manipulation and electrotherapy (TENS).
Electrodes were placed on the patients back in various locations before the TENS machine was started. The Chiropractor was negligent as she did not assess or clean the patient’s skin prior to applying electrode pads and a TENS unit for treatment. The Chiropractor failed to appropriately cleanse or prepare Plaintiff for electrotherapy by failing to sanitize, clean or remove any and all substances including, but not limited to, oils from the patient’s back prior to the placement of the electrodes.
After a few minutes of TENS treatment the patient reported he felt a burning sensation and asked the attendant to deactivate the TENS machine. As a result of the chiropractors’s negligent treatment of the patient, he suffered full thickness bums to his back which subsequently required surgical intervention,”
The suit seeks in excess of $30,000, the statutory minimum for filing in Palm Beach County Circuit Court. The suit also alleges the following:
“As a direct and proximate cause of aforementioned breaches of the recognized standard of care, Plaintiff, suffered bodily injury, resulting pain and suffering, disability, physical impairment, mental anguish, inconvenience, aggravation of preexisting disease or defect, expense of hospitalization, medical and nursing care and treatment, rehabilitative expenses, extraordinary expenses and the loss of capacity for the enjoyment of life. These losses are continuing in nature and Plaintiff will suffer these losses in the future. WHEREFORE, Plaintiff demands judgment plus costs and interest for damages against Defendant, and further demands trial by jury.” We note a lawsuit is an allegation.
