Charlotte Chiropractor Convicted of Child Sex Abuse

CHARLOTTE, TX - Charlotte chiropractor, Stuart White, has been convicted of felony child sexual abuse in Texas. He has been jailed in Texas after being convicted there this month for felony child sexual abuse. The chiropractor worked for Synergy Holistic Health in Charlotte. The conviction prompted White to write a letter to his patients, he maintains he was falsely accused of abusing children from a former marriage.

He said he’s committed to clearing his name. “I am appalled by the disturbing accusations leveled against me, as they are both disgusting and inconceivable,” his letter states. “I want to emphatically state that I would never engage in such reprehensible actions.” White’s current wife, Nicole Fodel, “is doing everything possible to hire the best appellate attorney to fight this false charge,” the chiropractic office stated in an email to patients that accompanied White’s letter. Fodel also works as a chiropractor and acupuncturist at the office. She could not immediately be reached for comment. Another letter accompanying the email invites people to contribute money “to restore Stuart’s freedom and exonerate his name.”

On Dec. 19, a jury in Harris County, Texas, convicted White of super aggravated sexual assault with a child under 6, a first-degree felony that carries a minimum sentence of 25 years in prison. He was found not guilty on a charge of indecency with a child. A judge is scheduled to sentence him on Jan. 23. Angela Weltin, one of White’s attorneys, stated in an email to The Observer that the defense team feels strongly that the case should be appealed. “Dr Stuart White will petition the court to review this case on appeal once sentencing occurs,” Weltin wrote. White was charged with the offense in 2014, three days after his ex-wife filed for divorce, according to the Houston Chronicle. White appears to have just one conviction in North Carolina — for speeding in Watauga County in 2017, a state criminal records check shows. In its online mission statement, Synergy Holistic Health says it treats “the entire person, not just their symptoms.” “Our goal is to not only alleviate pain and chronic illness, but more importantly, inspire and educate our patients to become active participants in their own well being,” the mission statement says.

Kalispell Chiropractors to Pay $450K for Medicaid Fraud

HELENA, MT Two Kalispell chiropractors will pay Montana $450,000 in restitution after Medicaid fraud allegations.

Cody C. Basler, 36, and Erik M. Lund, 30, will pay back funds to Montana Medicaid, along with civil penalties and damages.

According to the Montana Department of Justice, between May 2017 to December 2021, Basler and Lund submitted treatment claims to the Montana Medicaid program that were deemed not "medically necessary."

During this time, Basler owned and was the president of Basler.

Basler will pay a total of $300,000, with $267,000 going to the Montana Medicaid program.

Lund will pay a total of $150,000, with $87,000 going to the Montana Medicaid program. Due to the agreement to pay back Montana Medicaid, Basler and Lund do not admit to committing fraud.

The Montana Department of Justice released the following information:

Two chiropractors in Kalispell have agreed to pay the State $450,000 for restitution to settle allegations of Medicaid fraud, Attorney General Austin Knudsen announced today. The Montana Department of Justice’s Medicaid Fraud Control Unit (MFCU) received a referral from Blue Cross Blue Shield of Montana alleging Cody C. Basler, 36, and Erik M. Lund, 30, submitted claims to the Montana Medicaid program for treatment that was not “medically necessary,” as defined by the State of Montana, fr om May of 2017 to December of 2021. During that time, Basler was the owner and president of Basler Family Chiropractic and Lund was an employee.

During an investigation into both doctors’ records fr om May 2017 thr ough October 2021, MFCU identified claims that were non-reimbursable for reasons including that the referral was not directly related to a neuromuscularcondition of the spine, the documentation reflected a reason for treatment was “general wellness,” and they lacked documentation of a patient’s loss of function or impairment.

Under the terms of both agreements, Basler and Lund are not admitting to wrongdoing, however, both are repaying the money to Montana Medicaid. Basler agreed to pay a total of $300,000. The majority, $267,000, will reimburse the Montana Medicaid program and make it whole. The balance represents additional civil penalties and damages. Lund agreed to pay a total of $150,000 of which $87,000 will reimburse Montana Medicaid with the remainder representing civil penalties and damages.
